DECISION AND REASONS:

Following the running of Race 4, Oxford Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, by LEG SPINNER (M L Price), placed 5th by the judge, against SILVER JAZZ (T S Chmiel), placed 2nd by the judge, on the grounds of interference after 200 metres.

Mr Chmiel was present at the hearing of the information, as was the trainer and part-owner of SILVER JAZZ, Mr B G Buchanan.

Mr Ydgren stated that the Stipendiary Stewards were alleging that, shortly after the start, Mr Chmiel had crossed down to the marker line to a position already held by LEG SPINNER. Mr Chmiel had placed Mrs Price in “a tricky situation” where she has had to “restrain out” and lose the trailing position. Mr Chmiel had thereafter trailed the leader for most of the Race and had a better run in the run home. Mrs Price had raced 3-back and had been held up in the run home.

Mrs Price stated that she had received “very slight, minute” interference as a result of which she had to take hold of her horse. After that, she had to race 3-back instead of in the trail which was not as good a position she stated in reply to a question from Mr Ydgren. Her horse had been “travelling sweet” once it got going in the run home. She was not clear as to where the mare might have finished with a better run in the run home. In reply to questions from the Committee, Mrs Price was not adamant that she would have maintained the position behind the leader and she acknowledged that the incident took place very early in the Race.

Mr N G McIntyre, Stipendiary Steward, showed video replays of the incident and the final 200 metres of the Race. The Race was a 2000 metres standing start event. SILVER JAZZ started from barrier No.7 and LEG SPINNER from the inside of the second line. After 200 metres, SO FREE (K M Barron) was in the lead with LEG SPINNER “established” on the markers behind it and, Mr McIntyre said, Mrs Price had to “grab up” as a result of Mr Chmiel’s coming down the track. As a consequence, from the 1880 metres to the straight Mrs Price had to race 3-back on the markers with Mr Chmiel securing the trail behind the leader. The margin at the finish between the two horses was 1.4 lengths. Mr McIntyre, while acknowledging that the interference took place 1800 metres from home, submitted that interference had taken place and Mr Chmiel had gained an advantage.

Mr Chmiel said that the leader, SO FREE, had run off the fence, he had got onto its back, and had followed it down when SO FREE moved back down. Mrs Price’s horse was “not there” at that point but, at the last minute, Mrs Price “poked up”. He had thought he was clear to go in. Mr Chmiel argued that the chances of LEG SPINNER were not affected in any event as, he submitted, the horse was not making ground in the straight and was “flat” 50 metres out. The alleged interference did not result in LEG SPINNER breaking. There was “pushing and shoving” in the first 200 metres of every race, Mr Chmiel said.

The Committee had considered the evidence and submissions of the parties and had carefully viewed the video replays. While the Committee found that there was some interference, it appeared to be of a relatively minor nature as was acknowledged by Mrs Price who described it as “very slight” and “minute”. Furthermore, it was extremely difficult, having regard to the early stage of the Race at which this interference took place, to assess the extent to which the chances of LEG SPINNER were affected, if at all. Mrs Price was not even prepared to state with certainty that the interference had cost her horse the trailing position behind the leader. In all of the circumstances and having regard to all of the evidence, the Committee was not satisfied that the interference, which was minimal per se, had affected the progress or chances of LEG SPINNER in the Race which appeared to have every chance in the run home of finishing in a higher position. Finally, the Committee was not satisfied that SILVER JAZZ gained any material advantage over LEG SPINNER as a result of the interference.

Accordingly, the protest was dismissed and the judge’s placing stand.
