Following the running of Race 10, Woodend Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mrs J L Williams, alleging a breach of Rule 857 (7) (g) in that Mrs Williams “failed to come up into or maintain her position behind the mobile while driving KONNI KASE”.

DECISION AND REASONS:
--Following the running of Race 10, Woodend Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mrs J L Williams, alleging a breach of Rule 857 (7) (g) in that Mrs Williams “failed to come up into or maintain her position behind the mobile while driving KONNI KASE”.

Mrs Williams was present at the hearing of the information and did not admit the breach.

The Race was a 2600 metres mobile start event and KONNI KASE drew barrier No.8.

Mr Ydgren said that it was alleged that Mrs Williams had failed to come up to the mobile gate and/or maintain her position. Mr Ydgren stated that Mrs Williams and Mr A M Butt behind CLOUDY GUEST, which drew barrier No.9, should have been the first two horses up to the mobile. He alleged that Mrs Williams did not get within a length of the mobile and, at no stage, appeared to make any effort to do so.

Mr N G McIntyre, Stipendiary Steward, said that he had viewed the Race from the patrol box at the top of the straight. He said that by the time the field had progressed round past his position into the straight he heard the starter, Mr Lamb, calling out to Mrs Williams to come up and take her position. Mr McIntyre showed video replays from several angles. He pointed out Mrs Williams and alleged that she showed no “demonstrable or discernible” actions to get her

horse up at release. By that time, it was too late. Mr McIntyre said that it may have got “tight” some distance before the start but Mrs Williams should have been “already there in position”. At the time the gate was leaving, there was a clear gap for Mrs Williams to progress into, he said.

Mrs Williams stated that when the field started off there was room but, when she started to come up, the gap “eased up a little bit”. She said that the inside horse “had its head round a little bit” and then it came back out. She acknowledged that she did leave it too late but, at the time her horse was starting to go up on the mobile, the gap closed momentarily, she said. Mrs Williams also referred to the video replays. She said that the mobile was moving quickly and she did not want to “slap her up” in case the mare went off stride.

The Committee was not persuaded by Mrs Williams’ argument. This was, in the Committee’s view, a clear breach by Mrs Williams of her obligation to “come up into and/or maintain her position” as required by the Rule. Mrs Williams had an opportunity to get into her position much earlier that she attempted to and, further, the Committee did not accept her argument that prior to the start there was no gap for her. She did have the opportunity to get much closer to the mobile gate than she did. The evidence of the Stipendiary Stewards, supported by the video replays, was quite compelling. The charge was found proved.

Mr Ydgren informed the Committee that Mrs Williams had not previously breached the Rule. He recommended a fine of $100. Mrs Williams had no submissions to make in relation to penalty.

Mrs Williams was fined the sum of $100.
