FACTS:

--

Following the running of Race 1, Welcome to Wai-Eyre Farm Stallions Raceday Pace, Information No. 13712 instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against UNDUE RISK (J T Keast), placed 1st by the judge, on the ground that it broke from its gait “just prior to the finish” and was lapped on.

The judge’s official margins were a neck, a nose, ½ length and a head.

--

Mr J T Keast, driver of UNDUE RISK, was present at the hearing of the information and he informed the Committee that he was representing the connections of the horse in the protest hearing.

Rule 870 provides as follows:

--

(5)     Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or horseman,  then (subject to Rule 869 (8))such relegation of the horse shall be at the discretion of the Judicial Committee.

Mr Escott produced the official photo finish of the race which, he alleged, showed UNDUE RISK in a break.

Mr N M Ydgren, Stipendiary Steward, showed a video replay of the final stages of the race. He alleged that it showed that UNDUE RISK had galloped just short of the finishing line and had continued in a gallop to the finishing line.

Mr Keast disputed Mr Escott’s allegation. He suggested that the angle of the camera was from past the finishing line. He asked for the head-on video replay to be shown to the hearing which, he submitted, showed that the mare was not in a gallop when it crossed the finishing line. He admitted that it had paced roughly prior to the finishing line but maintained that it had not galloped until past the line.

Mr Keast was shown the photo finish. He submitted that the mare had “gone incredibly rough but had not galloped at that stage”. He said that she had “put in about four rough ones” before she actually galloped.

REASONS:

--

The Committee was satisfied, both from the video evidence and the photo finish of the race, that UNDUE RISK had galloped prior to the finishing line and that it was not in its correct gait when its nose reached the finishing line. The Committee was further satisfied that it was lapped on by SO GREEN and MAGICAL MEL, placed 2nd and 3rd respectively, both in their correct gait.

The protest was upheld and UNDUE RISK was relegated from 1st to 3rd placing.

Consequent upon the relegation, the amended result for the result is as follows:
