Following the running of Race 2, Ice Bloodstock Limited Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr R J Butt, alleging a breach of Rule 869 (2) (a) in that Mr Butt, as the driver of BLACK CRACKER in the Race, “used his whip excessively in the run home”.

DECISION AND REASONS:
Following the running of Race 2, Ice Bloodstock Limited Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Junior Driver, Mr R J Butt, alleging a breach of Rule 869 (2) (a) in that Mr Butt, as the driver of BLACK CRACKER in the Race, “used his whip excessively in the run home”.

Mr Butt was present at the hearing of the information. He stated that he declined the opportunity to be assisted by a senior horseman. He indicated that he admitted the breach. The breach was found proved accordingly.

Mr Ydgren showed a video replay of the final 300-400 metres of the Race. He pointed out Mr Butt on BLACK CRACKER in the lead turning into the home straight. Mr Ydgren alleged that Mr Butt had used his whip approximately 8 times in a rapid fire sequence shortly after turning for home. He continued to use the whip in the run home – a total of approximately 25 times. This was not disputed by Mr Butt. Some of the whip uses were “fakes”.

Mr Ydgren informed the Committee that Mr Butt had been fined $200 for a breach of the Rule on 26 February last. It was not an excuse for a breach of the Rule that the horse was a $2 favourite, he said. He recommended a fine of $300.

Mr Butt did not wish to make any submissions in relation to penalty.

The Committee expressed to Mr Butt its concern that this breach, which it considered to be in the mid to high range, was committed so soon after the breach of the same Rule just a week ago. Having said that, the Committee was prepared to give Mr Butt credit for his frank admission of the breach and the Committee also took into account Mr Butt’s junior driver status. In the circumstances, the Committee was prepared to take a lenient view in determining penalty.

Mr Butt was fined the sum of $250.

--

Mr Butt was warned by the Committee that any further breach of this Rule in the near future will likely result in a term of suspension of licence. The Committee recorded the warning as an official one that may be referred to if Mr Butt appears again on a charge of breaching the whip Rule.
