Following the running of Race 1, North Canterbury Trotting Owners Association Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr P C Nairn, alleging a breach of Rule 869 (2) (a) in that Mr Nairn, as the driver of MCREADY in the Race, “used his whip excessively in the run home”.

Following the running of Race 1, North Canterbury Trotting Owners Association Trot, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Driver, Mr P C Nairn, alleging a breach of Rule 869 (2) (a) in that Mr Nairn, as the driver of MCREADY in the Race, “used his whip excessively in the run home”.
Mr Nairn was present at the hearing of the information and indicated that he admitted the breach. The breach was found proved accordingly.
--Mr Ydgren showed a video replay of the final 600 metres of the Race. He pointed out Mr Nairn on MCREADY racing 4-back on the pylons. Mr Ydgren alleged that Mr Nairn had used his whip some 24-29 times in the final 450 metres of the Race. This was far too high in the view of the Stewards, Mr Ydgren said. At the top of the straight, Mr Nairn had the whip in the same hand as the reins but the whip was up and being used at the same time as the reins. Mr Nairn’s actions were “relentless” and he showed no respite over the final stages, Mr Ydgren said. His driving was outside the provisions of the Rule and the guidelines.
--Mr Nairn said that the horse was lazy and, even with a round to go, it was “not wanting to keep up”. Mr Nairn showed this on a video replay. It was not a case of the horse being tired, it just was not trying, he submitted. He had lost a good position down the back straight when it dropped back 3-4 lengths after being in the 1/1. He was trying to give the horse every possible chance. The only time that the horse got “interested” was halfway down the home straight when he “poked up” between other horses.
--Mr Ydgren informed the Committee that Mr Nairn had been fined $200 for a breach of the Rule on 10 September 2009. He has had 36 drives to date this season. He recommended a fine of $300-400 or a suspension of 4-5 days.
--Mr Nairn stated that he preferred a suspension to a fine.
--The Committee had regard to Mr Nairn’s admission of the breach, his explanation and his preference for a suspension over a fine.
--Mr Nairn’s licence was suspended for a period commencing after the close of racing on Sunday, 7 March 2010 up to and including Sunday 14 March 2010 – effectively, 4 days.
