Charge:

Alleging a breach of Rule 862 (2)

Facts:

Following the running of Race 3, Game Bid Trot, an information was filed by Stipendiary Steward, Mrs K R Williams against Licensed Junior Driver, Miss S J Ottley, alleging a breach of Rule 862 (2) in that, as the driver of SPOT ON GAMBLE in the race, she “permitted her horse to start in the incorrect barrier position”.

Miss Ottley was present, assisted by Licensed Open Horseman, Mr K M Barron, at the hearing of the information and she indicated that she admitted the breach. The breach was found proved accordingly.

Rule 862 provides as follows:
(2) No horseman shall permit a horse to start and no horse shall start other than from its correct barrier position (either at a standing or mobile start), unless directed by the Starter in accordance with Rule 860 (8).

Submissions for Decision:

Mrs Williams informed the Committee that, in Race 3, there were four horses on the unruly mark for the 2600 metres standing start event – WESTMELTON WILLIE (U1), SPOT ON GAMBLE (U2) driven by Miss Ottley, LITTLE TOMTOM (U3) driven by Mr L D McCormick and TIP YOUR HAT LOUI (U4). Mrs Williams said that SPOT ON GAMBLE and LITTLE TOMTOM had started from U3 and U2 respectively. The two horses had, effectively, swapped starting positions. Both drivers were equally at fault, Mrs Williams submitted. Mrs Williams showed a video replay of the start of the race which clearly confirmed her allegation.

Mrs Williams explained that neither horse had finished in a stake-bearing placing which avoided the necessity for a protest.

Mr Barron, on behalf of Miss Ottley, informed the Committee that the trainer of the horse had instructed Miss Ottley to arrive late to the start and stand back from the start to assist the horse to begin better. He submitted that LITTLE TOMTOM had not gone wide enough towards the outside horse as the horse turned. These had been contributing factors, Mr Barron submitted.

Submissions for Penalty:

Mrs Williams submitted that a fine of $200 was appropriate, which submission took into account Miss Ottley’s junior driver status. She referred to a fine of $200 imposed on another driver in July 2010 for a breach of the same Rule.

Reasons for Penalty:

In determining penalty, the Committee had regard to Miss Ottley’s admission of the breach, her clear record and her junior driver status. The Committee was aware of two recent breaches of the Rule that were dealt with by fines of $250 and $200. The Committee also took into account the submissions of Mr Barron on Miss Ottley’s behalf.
