DECISION AND REASONS:
--Following the running of Race 10, Easylawn?Centrefold Flashings Ltd Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Trainer, Mr P A Toomey, alleging a breach of Rule 864 (2) (d) in that the hopple carrier on MICKY?S LAST, trained by Mr Toomey, came adrift during the running causing that horse to break and be pulled up.
----Mr Toomey attended the hearing of the information and admitted the breach. He produced the offending piece of gear and freely admitted that it had come adrift. He could offer no explanation for that happening and did not attempt to offer any excuse.
----Mr Ydgren confirmed that Mr Toomey had a clear record. Mr Toomey submitted that he had not breached this particular Rule on any previous occasion.
----The charge was found to be proved and Mr Toomey was fined the sum of $150.00, having regard to his frank admission of the breach and his previous excellent record.
