Facts:

Following the running of Race 1, the Glenferrie Farm Trotting Mares Series Mobile Trot, an Information was filed by Stipendiary Steward Mr S. P. Renault against Open Horseman Mr M. P. Jones alleging a breach of Rule 869(4) in that he drove in a manner that caused his own horse to break.

The charge reads as follows.

“I the above named informant allege that the above named Defendant committed a breach of Rule 869(4) in that horseman M. Jones drove “Another Player” in a manner which caused this horse to break with 1100m to race.”

Rule 869(4) reads as follows.

“(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.”

Submissions for Decision:

Mr Jones had indicated on the Information that this breach of the Rules was not admitted, and he agreed that he understood the charge and the Rule it was brought under.

Mr Renault gave evidence and used video coverage to show that at about the 1100 metre mark Mr Jones was driving “Another Player” (7) when that horse’s near front leg struck the sulky of “Endeavour Sunset” (3) which he was trailing at that time. As a result “Another Player” broke and lost ground. Mr Renault said that Mr Jones had got too close to the horse he was trailing, and that this was an error of judgement on his part.

Mr Jones said that he was not aware that he had made contact with “Endeavour Sunset’s” sulky at the time. He said that his horse was wearing a piece of gear [later identified as a “kicking strap’ or “bucking strap”] which he had not previously experienced on a horse. This strap is worn around the back of the horse, but shortly before this incident it had moved out of its correct place and up next to the crupper. Mr Jones said that this might have made his horse race more keenly. He also said that at the time of the incident he was restraining his horse, and that he did not “allow” it to strike the sulky in front of him.

After hearing the evidence we adjourned to consider our decision.

Reasons for Decision:

We carefully considered the evidence and the video coverage. We were satisfied that there was no dispute that the near front leg of “Another Player” had made contact with the sulky of “Endeavour Sunset” causing “Another Player” to break. The question we had to answer was – did Mr Jones drive in a manner which caused this interference to his own horse?

From the evidence we were satisfied that the problem with the kicking strap confused the situation, and this may have resulted in “Another Player” striking the sulky of the horse it was trailing. We accept that Mr Jones had a good hold of his horse at the time and that he did not allow his horse to strike the sulky.

We decided that, taking all the evidence into account, that there was some doubt that Mr Jones was the cause of the incident and that the charge should be dismissed.

On resuming the hearing we advised the parties that a full written decision would be given later, and of our decision to dismiss the charge.
