The protest was upheld. SUMMERHILL JACK was relegated to 3rd placing and HANNAH JAYE was promoted to 2nd placing.

The final result for the race is as follows:
1st - 3 Shudawudacuda
2nd - 6 Hannah Jaye
3rd - 5 Summerhill Jack
4th - 10 Light the Fuse
5th - 11 Leave Mealone

It was ordered that dividends and stakes be paid in accordance with that amended result.

 

Facts:

Following the running of Race 2, “Dancing Holmes” Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mr S W Wallis, by HANNAH JAYE (R J Butt), placed 3rd by the judge, against SUMMERHILL JACK (J H Hunter), placed 2nd by the judge, on the grounds that “over the concluding stages HANNAH JAYE broke after alleged interference by SUMMERHILL JACK”.

Mr J H Hunter, driver, part-owner and trainer of SUMMERHILL JACK, was present at the hearing of the information and he indicated that he was representing the connections of that horse.

Rule 869 provides as follows:
(8) The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:
(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or
(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses-
immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.

Submissions for Decision:

Mr Wallis showed video replays of the final 300 metres of the race. He pointed out SUMMERHILL JACK, driven by Mr Hunter, leading the field entering the final straight. HANNAH JAYE, driven by Mr Butt, was racing outside the leader. SHUDAWUDACUDA (G D O’Reilly) was trailing the leader and took the passing lane. Inside the final 100 metres, SUMMERHILL JACK made an abrupt outwards movement causing Mr Butt to “correct his line” and, shortly after, Mr Butt’s horse broke and continued in a gallop past the finishing line.

Mr Butt told the hearing that he was either going to win the race or at least “go close” before receiving the interference. Mr Butt said that there was definitely contact when Mr Hunter’s cart came out and struck his horse’s back legs.

Mr Hunter said that he did not believe that he had made contact with the legs of HANNAH JAYE. He said that that horse had not even “faltered” when his wheel went inside its wheel. It was another stride or two before HANNAH JAYE broke. He did not feel any contact other than the carts touching. He admitted that his horse did “duck out” as a result of touching the inside runner and running away from it. His horse was “a bit green”, he submitted.

Mr Wallis illustrated by reference to the head-on video replay that Mr Hunter’s wheel was inside the wheel of Mr Butt’s sulky just prior to Mr Butt’s horse going off stride.

Reasons for Decision:

The Committee was satisfied that, inside the final 100 metres of the race, SUMMERHILL JACK, driven by Mr Hunter, while racing in or disputing the lead with SHUDAWUDACUDA, made a sudden outwards movement and made contact with the back legs of HANNAH JAYE, which was making ground on the outside of SUMMERHILL JACK. As a result of that, HANNAH JAYE went off stride and galloped for the remainder of the race, a distance of at least 50 metres, finishing in 3rd place. Although the margin between 2nd and 3rd was 1½ lengths, the Committee was satisfied that the progress or chance of HANNAH JAYE was affected. In this regard, it placed some weight on the evidence of Mr Butt and its own observations of the video replays.
