Following the running of Race 7, Chamberlain Suspension Rangiora Winter Cup, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr B A Lilley, alleging that Mr Lilley failed to affix the removeable hood to CHARMER DIRECT, trained by him, as not to malfunction.
| -- DECISION AND REASONS: --Following the running of Race 7, Chamberlain Suspension Rangiora Winter Cup, an information was filed by Stipendiary Steward, Mr N G McIntyre, against Licensed Trainer, Mr B A Lilley, alleging that Mr Lilley failed to affix the removeable hood to CHARMER DIRECT, trained by him, as not to malfunction. ----Mr Lilley did not admit the charge. ----Mr McIntyre said that it was noticed in the birdcage following the race won by CHARMER DIRECT that the removeable hood on that horse had not come off. The cord which was passed to him by the driver, Mr C T Woodward, was found to be in good condition. However, Mr McIntyre submitted, that the Rule was one of strict liability. Mr Woodward had unsuccessfully attempted to pull the cord on the removeable hood and Mr McIntyre showed this on a video replay. ----Mr Lilley stated that the hood and cord were both brand new and had been used on one previous occasion, at Addington on 1 July. The clip at the hood end of the cord had "disintegrated", Mr Lilley said. The gear was fixed in exactly the same manner as at Addington where no problem had been experienced. In today's race, the driver had given the cord "a good pull" and the clip malfunctioned. He believed he, Mr Lilley, had done all that could be expected of him. ------ Following an adjournment for the running of a race, the Committee indicated to the parties that it proposed to amend the information (pursuant to Rule 1111(4)) to allege a breach of Rule 864 (2) (b), having heard Mr Lilley's explanation. Rule 864 (2) (b) was read to Mr Lilley along with the "strict liability" Rule, Rule 1008. Mr Lilley thereupon indicated that he admitted the amended charge. ----The charge was found to be proved. ----Mr McIntyre recommended a $100 fine.
