DECISION AND REASONS:

Following the running of Race 5, Anthony Shearer Prime Panels Pace, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against STAY WITH POPLAR (S R McNally), placed 1st by the judge, on the ground of interference to IF BY CHANCE (T S Chmiel), placed 2nd by the judge.

Mr Chmiel represented the connections of IF BY CHANCE. Mr M G Larter, trainer of STAY WITH POPLAR, was also present.

Mr McIntyre informed the Committee that the protest related to an incident that occurred at the 300 metres. On returning to the birdcage, Mr Chmiel reported to the Stipendiary Stewards that his sulky tyre had been punctured by STAY WITH POPLAR with 300 metres to run.

Mr Chmiel gave evidence that his tyre was punctured by STAY WITH POPLAR clipping his sulky wheel. He showed on a video replay that he looked around when it happened. He stated that the tyre went flat straight away. He acknowledged that Mr McNally had lost ground as a result and probably could have beaten him anyway. It was difficult to say how the flat tyre affected the outcome.

Mr McIntyre informed the Committee that the winning margin was a head.

Mr McNally stated that his horse was "travelling very hard on the bit" and, when Mr Chmiel moved out, he was hard on his back and struck his tyre. Mr McNally said that he lost "a fair bit

of ground" as a result. He did not believe that the flat tyre would have made any difference to Mr Chmiel's horse over such a short distance. STAY WITH POPLAR would have won by more but for losing ground in the incident, Mr McNally said.

Mr Larter submitted that STAY WITH POPLAR had lost ground after clipping the wheel of IF BY CHANCE.

The Committee dismissed the protest and the placings for the race stand. There was no evidence given as to the effect of IF BY CHANCE having to pull a punctured tyre for 300 metres and, therefore, whether its progress or chances were affected. Furthermore, the Committee was not satisfied that, in the circumstances it could be said that interference took place. Given those matters, coupled with the fact, which was accepted by both parties, that STAY WITH POPLAR had lost ground and had deservedly won the race suggest that the result of the race should not be interfered with. Had the Committee been required to exercise a discretion, that factor would have weighed heavily against relegation.
