The protest was upheld and KD HAWK was relegated to 5th placing.

Consequent upon the relegation, the amended result for the race is as follows:
1st - 1 I Dream of Jeannie
2nd - 3 Steel Dust
3rd - 10 Black Jacket
4th - 14 Lane’s Ace
5th - 17 KD Hawk

It was ordered that dividends and stakes be paid in accordance with that amended result.

Facts:

Following the running of Race 1, Country Feasts Ltd Trot, an Information instigating a protest was filed by Stipendiary Steward, Ms CM Tibbs, against KD HAWK (RJ Butt) placed 4th by the judge, on the ground that it “galloped over the line and was lapped on” by the 5th placed runner, LANE’S ACE.

Mr Butt, representing the connections of KD HAWK, had signed the Information form indicating that he did not contest the protest and that he did not wish to be present at the hearing of the information.

The judge’s placings were as follows:

1st  - 1 I Dream of Jeannie
2nd - 3 Steel Dust
3rd - 10 Black Jacket
4th - 17 KD Hawk
5th - 14 Lane’s Ace
6th - 12 Pastrana

The official margins were a nose, a neck, a ling head and a ½ length.

Rule 870 provides:
(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869A) such relegation of the horse.

Submissions for Decision:

Ms Tibbs showed a video replay of the final stages of the race. She pointed out KD HAWK, driven by Mr Butt, racing in 4th position, go into a break just short of the finishing line and continue on in a break to the finishing line, finishing in 4th position.

Ms Tibbs also pointed out that KD HAWK had been lapped on by LANE’S ACE, placed 5th by the judge. The judge’s official margin between 4th and 5th was a ½ length. She sought relegation of KD HAWK to 5th placing behind LANE’S ACE. 

Reasons for Decision:

The Committee was satisfied that KD HAWK had gone into a gallop, free of interference, prior to the finishing line and was in a gallop when its nose reached the finishing line. The Committee was further satisfied that it was lapped on by the 5th placed runner, LANE’S ACE, in its correct gait. Finally, the Committee noted that Mr Butt did not contest the relegation of KD HAWK.
