Facts:

Following the running of Race 10, Rangiora International Handicap Trot, an Information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against GEE UP NEDDY (C J DeFilippi) placed 1st by the judge, on the ground that “GEE UP NEDDY galloped in excess of 150 metres in the early stages”.

Mr P N Jones was present at the hearing of the information, representing the owner/trainer of GEE UP NEDDY.

The judge’s official placings for the race were:
1st  - 1 Gee Up Neddy
2nd - 4 William Lance
3rd  - 5 Live the Dream
4th  - 2 Kowhai Whiz
5th  - 3 Wanna Play

Rule 870 provides as follows:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:
(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or
(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr Ydgren showed a video replay of the start of the race, a standing start 2600 metres race for c4 and faster trotters. He pointed out GEE UP NEDDY, driven by Mr DeFilippi, drawn at barrier position 1 on the front row. When the tape was released, GEE UP NEDDY trotted off the mark to the first pylon (20 metres) and galloped soon thereafter, Mr Ydgren said.

The horse continued in a gallop past the marker on the inside of the track marking the point 150 metres after the start. Mr Ydgren pointed out that marker on the video replay. The horse then went out of shot. From that, Mr Ydgren showed the pylon that was an estimated 20 metres after that point, allowing for the distance of 20 metres for which the horse had been in its correct gait after the start. He then referred to the head-on video replay although, he conceded, it was difficult to establish the precise point at which GEE UP NEDDY had regained its proper gait.

Mr Jones said that, having regard to the distance over which the horse was in its correct gait after the start, it was “very debateable” whether the horse had galloped for 150 metres or more. He submitted that the videos showed that it had not.

Mr Ydgren submitted that there was some doubt that the horse had galloped for 150 metres or more.

Reasons for Decision:

The Committee was satisfied that GEE UP NEDDY had broken from its gait approximately 20 metres after the start of the race and had continued on in a gallop for some distance. However, the Committee could not be satisfied that that distance over which it had galloped was a distance of 150 metres or greater. The video evidence was not conclusive one way or the other but the distance could, quite conceivably, have been less than the 150 metres threshold provided in the Regulation (see above). Since the Committee could not be satisfied on a balance of probabilities, the protest was dismissed.
