DECISION AND REASONS:

Following the running of Race 5, Bramley Farm Mobile Pace, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Open Driver, Mr L J Wigzell, alleging that Mr Wigzell, as the driver of DECOY RUNNER in the Race, "drove carelessly when attempting to hold out MONTEGO HANOVER (C J De Filippi) after approximately 200 metres causing his own horse to break".

Mr Wigzell was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

The Easing Down Regulation provides:

--

Any horseman who fails to concede when not in a position to maintain his/her place, may be charged under Rule 869 (3) Careless Driving.

Mrs Williams showed video replays of the first 400-500 metres of the Race. She pointed out DECOY RUNNER, driven by Mr Wigzell, which had drawn 3 behind the mobile barrier at the 2600 metres start. MONTEGO HANOVER, driven by Mr C J DE Filippi had drawn 5. Shortly after the start, Mr Wigzell was attempting to get on the back of SALLY PATRON (C R Thornley). Mr De Filippi was in front of Mr Wigzell and was easing back. Mr Wigzell was not keeping up, Mrs Williams stated, and Mr De Filippi was "more than entitled" to attempt to ease Mr Wigzell down. Mr Wigzell continued to "fight" for some distance resulting in his horse breaking. Mr De Filippi had, possibly, a horse-length advantage, Mrs Williams stated.

Mr Wigzell stated that, at the time, Mr De Filippi did not seem to have as much advantage as he appeared to have on the video replays. He stated that he was just trying to hold his ground but Mr De Filippi was able to get ahead of him. Mr De Filippi’s sulky wheel touched his horse’s leg causing it to break. He submitted that both horses were going for the same position.

Mr Wigzell expressed a preference for a term of suspension rather than a fine.

Having regard to Mr Wigzell’s admission of the breach and the submissions of the parties, Mr Wigzell’s Open Driver’s Licence was suspended from after the close of racing on 5 January 2008 up to and including Friday, 18 January 2008, effectively 2 driving days.
