Following the running of Race 1, Harness Racing North Canterbury Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr W E Higgs, alleging a breach of the Sulky Fund Regulations in that Mr Higgs "raced COQ D’OR in an unwarranted sulky".

Following the running of Race 1, Harness Racing North Canterbury Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Trainer, Mr W E Higgs, alleging a breach of the Sulky Fund Regulations in that Mr Higgs "raced COQ D’OR in an unwarranted sulky".
----The Statement by the Defendant on the information form had been signed by Mr Higgs’ "agent", Mr J W Morris, indicating, firstly, that Mr Higgs admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. Mrs Williams informed the Committee that Mr Morris had telephoned Mr Higgs and obtained authority to accept service of the information and admit the breach on his behalf. The breach was found proved accordingly.
----The Sulky Fund Regulations provides as follows:
------5. From August 1 2008 only currently registered sulkies shall be permitted to be used at races, trials and workouts. In addition, prior to 31 January in each season (or such other date as the Executive may direct) every registered sulky shall be subject to a Warrant or Fitness Inspection in such form as shall be prescribed by the Executive.
--7. HRNZ or their approved Warrant of Fitness Issuer may issue a warrant of Fitness label which shall be affixed onto the crossbar in front of the footrests or such other position as directed by a Stipendiary Steward.
----Mrs Williams explained to the Committee that the "label" is in the form of a very visible orange tag. There was no such tag affixed to the sulky of COQ D’OR, which was readily admitted, she said.
----Mrs Williams informed the Committee that this was the first charge under the Regulations. She recommended a fine of $100.
----Mr Higgs was fined the sum of $100.
