DECISION AND REASONS:
--An information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainer, Mr K M Barron, alleging that MITCHEALS BAY, trained by Mr Barron, an acceptor for Race 4, Mike Stratford Property Developments / Canterbury Amateur Drivers Assn Pace, was late scratched by Mr Barron at 9.20am on race morning instead of before the scratching time of 5.00pm the previous day.
----Service of the information was effected on Mr C McDowell as authorised agent of Mr Barron. Mr McDowell was present at the hearing of the information and admitted the breach which, accordingly, was found proved.
----Mrs Williams said that she had spoken by phone with Mr Barron. MITCHEALS BAY had raced at Addington on 27 April. He had discussed with Mr B P Rabbitt scratching the horse from today's race prior to its racing at Addington but it was decided to leave it in the Race in case something happened in the Addington race. Mr Barron then forgot to ring Mr Rabbitt prior to 5.00pm yesterday. No other horse was denied a start in the Race as a result of the late scratching, Mrs Williams said. She said that Mr Barron had been very honest in relation to the matter but the responsibility to scratch before the deadline was solely his. She sought a fine of $200.
----Mr Rabbitt said that he had had a conversation with Mr Barron on Thursday, 26 April last. He suggested to Mr Barron at that time that he leave the horse in Sunday's field until after Friday night's race. When he had not heard again from Mr Mr Barron, Mr Rabbitt assumed that Mr Barron had heard that there had been a number of scratchings for Sunday's race and had decided to leave MITCHEALS BAY in the field. However, this was not Mr Barron's intention.
----Mr McDowell did not wish to add anything to what had been said.
----The Committee delivered the following oral decision in relation to penalty:
--"There has clearly been some confusion and, perhaps, a lack of or a breakdown in communication. I also note the fact that no other horse was deprived of a run in the race. I think probably some leniency is called for here. There has been a breach, and that has been admitted, but is not a serious or flagrant breach of the Rule. So, I think perhaps a fine of $100 might be appropriate and Mr Barron is fined $100 accordingly".
