Decision:

This committee is satisfied that "Kylie Castleton was out of its proper gait for a distance in excess of 50 metres or greater in the last 200 metres of the race and it is disqualified accordingly.

Amended placings are:

  1. Horse 9 - "Tessa's Rocket"
  2. Horse 3 - "Unyielding Spirit"
  3. Horse 7 - "Nicaela"
  4. Horse 1 - "Cuddly Jess"
  5. Horse 5 - "Kerryn Kylie".

Dividends and stakes are to be paid in accordance with the amended placings.

Facts:

In the concluding stages of the "Okuku River" The Breeders Golden Girls Series (Heat 2) Mobile Trot, "Kylie Castleton" driven by C Ferguson, broke from its gait just prior to the 50 metres mark from the winning post. It continued on out of its gait until well past the post. The video evidence of the  incident was shown to the hearing and explained by Mr Renault. It was clear that the horse broke from its gait of its own accord.

The information was endorsed by Mr Ferguson stating that he did not contest the protest.

Submissions for Decision:

Mr Wallis submitted that as "Kylie Castleton" was quite clearly out of its gait for a distance of 50 metres or greater in the last 200 metres of the race that  the horse should be disqualified.

Reasons for Decision:

The video evidence established quite clearly that "Kylie Castleton" was out of its gait, of its own accord and which was not as a result of interference from another horse.Thus there has been a clear breach of Rule 870(3).
