Following the running of Race 8, Parklands Pawnbrokers Three-Year-Old Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr B Weaver, alleging a breach of Rule 864 (2) (d) in that “the earplugs on SUNSET DREAM [trained by him] malfunctioned and could not be activated in the run home”.

Following the running of Race 8, Parklands Pawnbrokers Three-Year-Old Mobile Pace, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Public Trainer, Mr B Weaver, alleging a breach of Rule 864 (2) (d) in that “the earplugs on SUNSET DREAM [trained by him] malfunctioned and could not be activated in the run home”.
--Rule 864 provides as follows:
(2) Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that:-
(d) all gear is correctly applied and/or affixed so as not to malfunction or come adrift.
Mr Weaver had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.
--Mr Renault informed the Committee that Mr Weaver had a clear record. He recommended a fine of $100.
--The Committee had regard to Mr Weaver’s admission of the breach and his previous good record.
--Mr Weaver was fined the sum of $100.
