Following the running of Race 1, Ashley Hotel Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr J P Wheeler, alleging a breach of Rule 869 (4) and (6) (b) & (c), in that Mr Wheeler, as the river of ALYAK NOVA in the Race, “improved 3 wide with 1200 metres to run forcing OSCAR (J W Smith) to race wider on the track”.

Following the running of Race 1, Ashley Hotel Trot, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Driver, Mr J P Wheeler, alleging a breach of Rule 869 (4) and (6) (b) & (c), in that Mr Wheeler, as the river of ALYAK NOVA in the Race, “improved 3 wide with 1200 metres to run forcing OSCAR (J W Smith) to race wider on the track”.

Mr Wheeler had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly, that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.

(6)  Subject to sub-rule (4) (b) hereof:-
(b)  a horse making a forward movement during any race shall not be forced to race wider on the track;
(c) a horse during a race shall not move ground outwards once the nose of the wider runner coming forward is in line with or past its sulky wheel and until the wider runner going forward is fully past.

Mr Renault showed a video replay of the incident with approximately 110 metres to run. He pointed out Mr Wheeler on ALYAK NOVA in the one-out, one-back position with OSCAR improving round 3-wide. Mr Wheeler then pulled out to go 3-wide as OSCAR got up on its outside, forcing that horse to race 4-wide. ALYAK NOVA got across to sit outside the leader, OSCAR was forced to race 3-wide for the remainder of the Race.  Mr Wheeler was too late pulling out, Mr Renault said.

It was clear to the Committee that ALYAK NOVA had moved ground outwards after the nose of OSCAR, which was making a forward movement, was past its sulky wheel and, as a result, OSCAR was forced to race wider on the track. It was a clear breach of the “push-out Rule”.

Mr Renault informed the Committee that Mr Wheeler had no previous breaches of the Rule. He recommended a fine of $200.

--

The Committee took into account Mr Wheeler’s previous good record and his admission of the breach.

--

Mr Wheeler was fined the sum of $200.
