As Mr Reekie has admitted the charge it is therefore deemed to be proved.

Mr Reekie is fined $250.

Charge:

It was alleged that Mr R Reekie ("Cullen's Mercy"), shifted ground outwards near the 1400 metres mark, forcing "Electric Ollie" (A White) wider on the track.

Facts:

As the field approached the 1400 metres mark in the "Bishopdale-Bush Inn TAB's Amateur Drivers Mobile Pace", Mr Reekie moved his horse outwards when "Electric Ollie" was moving forwards on Mr Reekie's outside. The result was that the sulkies of each horse locked wheels, lost considerable ground and both horses took no further effective part in the race. As a consequence Mr Reekie was charged with a breach of the "Push Out" rule as it is commonly known.

Mr Reekie acknowledged that he had breached the rule and that he was in the wrong. He said that his horse was travelling "quite nicely" when he decided to make his move. He said that Mr White, the driver of "Electric Ollie" called out, that "You can't do that" and then proceeded to hold him in, with the consequence being the locking up of wheels and both horses losing all chances.

Submissions for Penalty:

Mr Wallis told the hearing that Mr Reekie had not been charged with a breach of this rule in the current racing season. He said that Mr Reekie's actions caused him to extinguish not only his own chances, but also the chances of "Electric Ollie". He submitted that a fine of $250 should be imposed.

Mr Reekie had no submissions to make on penalty.

Reasons for Penalty:

Mr Reekie has not been charged with a breach of the "push-out" rule in the current season. He has admitted the charge at an early opportunity. However, he was responsible for his own horse losing all chances as well as extinguishing the chances of "Electric Ollie". 

They are the mitigating and aggravating features of this case. After considering all matters, we are of the view that the penalty guide recommendation of a fine of $250 is appropriate.
