Facts:
It was alleged that as the field approached the first bend in the Bishopdale/Bush Inn TAB Tavern Harewood Mobile Pace, M Stratford, Amateur horseman drove in a manner that caused interference to "Billy Jack" (B White), and to trailing horses also receiving interference. Mr Renault, using the video coverage of the incident, pointed out how, Mr Stratford when racing three wide, moved down, coming into contact with "Billy Jack". In the process he caused general tightening which had an impact on three or four trailing horses, which were inconvenienced.
By way of explanation, Mr Stratford said that he was trying to "sneak into a gap" and made a misjudgement as to the amount of room available. He acknowledged that caused "Billy Jack" to hit his sulky wheel with the result that "Billy Jack" broke from its gait.
Submissions for Penalty:
Mr Renault submitted that Mr Stratford is a regular Amateur driver, who competes in most of the amateur races available. He said that Mr Stratford has a clear record pursuant to this rule. Notwithstanding that he noted that the starting point for the imposition of a fine is $400. However, he felt that Mr Stratford could be given credit for his early admission of the charge and for his good record.
Reasons for Penalty:
As Mr Renault has observed, the starting point in the Penalty Guide for Judicial Committees is a fine of $400 or a suspension equivalent to 8 drives. In this case there was no suggestion by either Mr Renault or Mr Stratford that a suspension should be imposed.
To our starting point, we impose an uplift of $50 to take into account the aggravating feature of the effect of Mr Stratford's breach of the rule, namely the impact on other horses. However, against that, we can allow a discount for the mitigating features referred to by Mr Renault, of $200, making the fine to be imposed $250.
