As Mr Hay admitted the breach the charge was found proved.

Facts:
Following the running of Race 6 the “Lone Star Riccarton Pace” an Information was filed by Chief Stipendiary Steward Mr N Ydgren alleging a breach of Rule 869(2) by Open Driver Mr J Hay. The information alleged, J Hay (THE GUILD) used his whip on more occasions than permitted by Clause (b) of the Use of Whip Regulations.
Mr Hay had signed the information stating he admitted the breach and that he did not want to be present at the hearing.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulation made by the Board.
The Use of Whip Regulation (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Ydgren used the race video with the assistance of Mrs Tibbs to identify Mr Hay driving (10) THE GUILD, racing 4 wide entering the home straight where after using his whip 15 times in the run to the finishing post.
Mr Ydgren stated Mr Hay in his defence said he was reining his horse in the early strikes and it was just a coincidence he had the whip in his hand.
Mr Ydgren said whether or not Mr Hay had a rein in his whip hand or not was irrelevant, the strikes were clear to see and Mr Hay is now aware of this and hopefully will take this forward to future races.

Mr Ydgren said this was a clear mid-range breach for which required the mandatory penalty for 15 strikes.
Reasons for Penalty:
The JCA Penalty Guide sliding scale provides for a fine of $300 for a breach of the regulations at this level, mitigation inclusive. The Committee considers this to be an appropriate penalty.
