Facts:
Following the running of Race 4, the Fasttrack Insurance Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N Ydgren, against Open Driver Ms S Ottley, alleging that “S Ottley (PERAKI REACTOR) drove carelessly near the 800 metres when allowing her horse to strike the sulky wheel of ONSPEED causing her runner to break.”
Ms Ottley confirmed that she understood the rule she was being charged with and indicated that she admitted the breach.
Rule 869 provides as follows:
(2) No horseman in any race shall drive: -
(b) carelessly
Mr Ydgren used the race films to identify Ms Ottley racing in last position approaching the 800-metre pole. He showed Ms Ottley shift outwards to commence a run and in doing so strike the outside wheel of ONSPEED (J Young) and gallop for several strides. Mr Ydgren said the incident was a complete lack of judgement from an experienced driver.
Ms Ottley stated her horse was green and as she angled out had jumped on the bit. She said she probably came out too sharply but it is what it is and had nothing more to add.
Submissions for Penalty:
Mr Ydgren stated Ms Ottley in the last six months or 200 drives has a clear record under the rule. He said the Penalty Guide eludes to a fine of $300 when a driver hits a wheel and the Stewards see this as mid-range and a fine of that nature appropriate.
Ms Ottley submitted the incident didn’t affect Ms Young, her own horse didn’t lose any ground and she would hope that would reflect on the level of fine.
Reasons for Penalty:
In determining penalty, the Committee considered this to be a mid-range breach and have adopted the JCA Penalty Guide starting point of a $300 fine for any time a driver hits a wheel with consequences. There are no aggravating factors to consider.
The mitigating factors are Ms Ottley’s good record and frank admission of the breach.
The Committee in considering all the above factors find that a $250 fine is appropriate in this case.
