Facts:
Following the running of Race 8, “Kotare Downs” Rangiora Three-Year-Old Stakes, an information was filed by Stipendiary Steward, Mr S P Renault, against Licensed Open Horseman, Mr T M Williams, alleging that, as the driver of THE MANIPULATOR in the race, he “drove carelessly when allowing THE MANIPULATOR to shift inwards and lock wheels with BRACKEN RIDGE which broke resulting in checks to TOOT TOOT, CHANGEOVER A FLYIN and EXPRESSO MARTINI”.
Mr Williams had signed the Statement by the Respondent on the information form indicating that he admitted the breach. Mr Renault informed that Committee that Mr Williams did not wish to be present at the hearing.
Rule 869 provides as follows:
(3) No horseman shall in any race drive:
(b) carelessly.
Mr Renault had Co-Chief Stipendiary Steward, Mr N G McIntyre, show the incident on video replays of the relevant part of the race.
He pointed out Mr Williams, driving THE MANIPULATOR, racing in the one-out/one-back position behind BRACKEN RIDGE (B N Orange), in the parked position, as the field approached the home turn. EXPRESSO MARTINI (M P Jones) had begun to progress 3-wide behind Mr Orange. Near the 500 metres, Mr Williams directed his horse outwards to force Mr Jones wider and improve to the outside of Mr Orange. However, Mr McIntyre said, Mr Williams had not given himself sufficient room to clear the outside sulky wheel of Mr Orange going round the bend. He pointed out that Mr Williams’ inside sulky wheel had gone inside the wheel of Mr Orange’s sulky. As a result, the wheels of the two sulkies locked. Both drivers attempted to free the wheels and, as a result, Mr Orange’s horse galloped and lost all chance, Mr McIntyre said. There were resultant checks to TOOT TOOT, CHANGEOVER A FLYIN and EXPRESSO MARTINI but none of those runners lost its chance, Mr Renault said.

Mr Williams has had 165 drives in the current season, Mr Renault said. He had 303 in the 2103/2014 season. Mr Williams has two relevant careless driving breaches on his record, Mr Renault said – 3.11.14 at Kaikoura (fined $275) and 29.11.14 at Geraldine (fined $350).
Mr Renault said that the Committee should take into account Mr Williams’ admission of the breach and that his driving record had been good for the last 5 months. He submitted that a fine of $350 was appropriate.
Reasons for Penalty:
In arriving at penalty, the Committee had regard to the starting point for penalty under the Penalty Guide of a $400 fine.
There were a couple of aggravating factors – namely, Mr Williams’ record and that another runner in the race had lost its chance as a result of Mr Williams’ carelessness. The Committee felt that these aggravating factors warranted an uplift of $100 in the starting point to $500.
Mr Williams was entitled to a discount for his admission of the breach and was entitled to some credit for his driving record. Whilst Mr Williams did have two relevant previous breaches on his record, the Committee was cognisant of the fact that Mr Williams is a busy driver and that the last of those two previous breaches was some 5 months ago. The Committee fixed the discount at $150.
