An information was filed by Mrs K R Williams, Stipendiary Steward, relating to Race 8, Legends Bar (Christchurch) Mobile Pace, alleging that Mr Dolan, as the trainer of INITAGAIN, an acceptor for the Race, "scratched INITAGAIN late after the gelding was bought and denied another horse a start".

DECISION AND REASONS:

An information was filed by Mrs K R Williams, Stipendiary Steward, relating to Race 8, Legends Bar (Christchurch) Mobile Pace, alleging that Mr Dolan, as the trainer of INITAGAIN, an acceptor for the Race, "scratched INITAGAIN late after the gelding was bought and denied another horse a start".

Mr Dolan admitted the breach.

Rule 834(2)(a) provides:

--

After the official right of re-entry time no person shall scratch a horse from a race unless there are sufficient circumstances which warrant the horse being scratched full details of which shall be given to the Stipendiary Steward in writing.

Mrs Williams informed the Committee that another horse had been denied a start as a result of the late scratching of INITAGAIN. Notification of the scratching was made at 11.20am on raceday. She recommended a fine of $200.

Mr Dolan acknowledged that he understood the procedure and admitted liability for the late scratching. He explained that the horse had been up for sale and he had hoped to hear from the buyers yesterday, as requested. The buyers had not made contact with him again until today and they had requested that the horse be withdrawn from tonight's race. He also indicated that the buyers had offered to pay any fine imposed on him as a result of the late scratching. He regretted that another horse had been denied a start.

Mr Dolan was fined the sum of $200.00.
