Following the running of Race 5, "Monarchy" Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against WHAT YOU CALL (K W O?Reilly), placed 2nd by the judge, on the grounds of interference to RADIUM (B A Kerr) in the run home.
| -- DECISION AND REASONS: --Following the running of Race 5, "Monarchy" Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against WHAT YOU CALL (K W O?Reilly), placed 2nd by the judge, on the grounds of interference to RADIUM (B A Kerr) in the run home. ----Mr O?Reilly, part-owner, trainer and driver of WHAT YOU CALL, was present at the hearing representing the connections of WHAT YOU CALL. ----Mr Kerr stated that he had been racing outside the leader with another horse outside him. He said that they had "smoked the last quarter" and his horse was getting unbalanced. The horse inside him, WHAT YOU CALL, did move out, he said, but he was not forced over extra ground or outwards and there was no contact made. His drive was just up past the wheel of WHAT YOU CALL. ----Mrs K R Williams showed the incident on video replays. Mrs Williams alleged that, when Mr O?Reilly reached down and pulled the earplugs on his horse, the horse moved out and momentarily tightened RADIUM, causing that horse to break. She stated that, in her view, Mr Kerr had been tightened for room and had to take hold of his horse. Mrs Williams submitted that, as the lead horse into the straight, Mr O?Reilly was obliged to maintain a straight course. If WHAT YOU CALL had not drifted out, RADIUM may have continued trotting and finished in the first five placings. She submitted that WHAT YOU CALL drifting out was the cause of RADIUM's breaking. ----Mr Kerr said that, if he had been travelling well enough, he would have been right up outside WHAT YOU CALL. His horse was tiring and he was "drifting off" and not trotting that well, he stated. RADIUM had broken and lost ground early. WHAT YOU CALL drifted out just as RADIUM had begun to trot roughly. ----In response to a question from the Committee, Mr Kerr said that he did not receive any interference that affected where RADIUM finished. He did not believe that the chances of RADIUM had been affected. ----Mr O?Reilly said that his horse had run out. It had gone to run down into the passing lane as he pulled the earplugs. He said he had corrected it but had over-corrected. He acknowledged that RADIUM had broken but said that there was no contact with that runner. ----ORAL DECISION OF COMMITTEE: --Having heard the evidence and seen the incident for myself, I must say that it did appear to me as though there may have been interference but, in the light of what Mr Kerr has said, it is difficult for me to ignore that. It appeared as though there might have been interference ? Mr Kerr said there has not been and he said that his chances were not affected. It is very difficult for me to ignore that and, in the light of Mr Kerr's evidence, I am not satisfied that there has been interference or that the chances of RADIUM have been affected and, therefore, the protest will be dismissed and the placings stand. ------ -- JUDICIAL COMMITTEE ----
