Dolan, licensed trainer of “Reiko Franco” (4), alleging a breach of Rules 865(1) and (4). It was alleged that “Reiko Franco” was presented with a removable hood instead of ear plugs with which it raced at its previous start on 11 December 2008.

Following the running of Race 1, the Redpaths Powerbase Mobile Pace, an information was laid by Stipendiary Steward Mr S. P. Renault against Mr S. A. Dolan, licensed trainer of “Reiko Franco” (4), alleging a breach of Rules 865(1) and (4). It was alleged that “Reiko Franco” was presented with a removable hood instead of ear plugs with which it raced at its previous start on 11 December 2008.

Mr Dolan had indicated on the information that he admitted this breach of the Rules and that he did not wish to attend the hearing.

Mr Renault advised that Mr Dolan had no previous convictions under this
--Rule, and a fine of $100-00 was recommended. I was satisfied that a fine of
--$100-00 was appropriate in this case and Mr Dolan was fined this amount.
