Following the running of Race 8, North Canterbury Trotting Michael Carrigg Memorial Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainers, Mr R M & Mrs J P Austin, alleging that "the pull down blinds failed to activate on IDLE INVASION", trained by them.

DECISION AND REASONS:

Following the running of Race 8, North Canterbury Trotting Michael Carrigg Memorial Handicap Trot, an information was filed by Stipendiary Steward, Mrs K R Williams, against Licensed Public Trainers, Mr R M & Mrs J P Austin, alleging that "the pull down blinds failed to activate on IDLE INVASION", trained by them.

Mrs Austin, who had driven the horse in the race, was present at the hearing of the information and, on behalf of the Defendants, did not admit the breach.

Mrs Williams informed the Committee that Mr N M Ydgren, Stipendiary Steward, had observed that the pull down blinds on IDLE INVASION had not come down. Mrs Williams said that Mrs Austin had obviously tried to pull them but they had not come down. The breach was one of strict liability, she submitted, and it was not necessary for the Stipendiary Stewards to prove why the blinds had not come down.

Mrs Austin informed the Committee that the blinds were "virtually brand new" and she had unsuccessfully attempted to pull them down. She attempted "two or three times, really hard" at a time when her horse was sprinting hard. She believed that she should not be penalised in those circumstances. The failure did not affect the horse's performance or placing, she submitted.

Having regard to the fact, as admitted by Mrs Austin, that the pull down blinds on IDLE INVASION failed to activate, as alleged, and having regard to the provisions of Rule 1008 (b), the charge was found to be proved.

Mr and Mrs Austin were fined the sum of $100.
