Facts:
It was alleged that Mr White used his whip in an excessive manner in the concluding stages of the "Bishopdale-Bush Inn TAB's Amateur Drivers Mobile Pace".
Mr White had endorsed the information admitting the breach of the rule and informed the Stipendiary Stewards that he did not wish to be present during the hearing.
Mr Renault demonstrated to the hearing the matter that he complained of using the video coverage from the home turn until the finishing post. In the concluding stages Mr White was shown to have used his whip approximately 22 times which in the opinion of the Stipendiary Stewards, was "too much". There were no discernible pauses in Mr White's whip action. He was beaten into second place by half a length.

Mr Renault advised the hearing that Mr White had been charged in September 2013 for excessive use of the whip and on that occasion was fined $200. He further said that Mr White was a busy amateur driver, competing as often as possible in Amateur Drivers races. Mr Renault submitted that a fine of $300 would be appropriate in this case.
Reasons for Penalty:
The starting point for the imposition of penalty in terms of the Penalty Guide for a second breach within a year is a fine of $500 or a suspension of 10 drives. We must then look to aggravating and mitigating factors in setting penalty.
In this case there were no aggravating factors which would warrant an uplift on the starting point. There are, however, mitigating factors in that Mr White admitted the breach at the earliest opportunity, and has a reasonable record for a busy amateur horseman. Those factors allow us to afford a discount on our starting point. of $200.
