Following the running of Race 7, Arthur Jacques Memorial Handicap Trot, an information instigating a protest was lodged by Chief Stipendiary Steward, Mr N R Escott, against ALLRIGHTY (A J McPherson), placed 2nd by the judge, on the grounds that, approximately 100 metres after the start, ALLRIGHTY broke checking BALISTIC MISSILE (R T May) and ONE KENNY (A C White) resulting in the latter runner breaking.
| -- DECISION AND REASONS: --Following the running of Race 7, Arthur Jacques Memorial Handicap Trot, an information instigating a protest was lodged by Chief Stipendiary Steward, Mr N R Escott, against ALLRIGHTY (A J McPherson), placed 2nd by the judge, on the grounds that, approximately 100 metres after the start, ALLRIGHTY broke checking BALISTIC MISSILE (R T May) and ONE KENNY (A C White) resulting in the latter runner breaking. ----Mr McPherson indicated that he represented the connections of ALLRIGHTY. ----Mr White said that he went back at the start. He then came up 2-wide, he said, where there was not a lot of room and he restrained back. He said that he did not see any interference and thought that it was just BALISTIC MISSILE moving down. There was no contact but he had to restrain his horse because of tightening and it broke. He did not see any reason why Mr May had come down ? he saw no interference to Mr May ? and thought Mr May was just looking for a better position. ----Mr May said that his horse was alongside ALLRIGHTY and pulled back to get in behind it when it galloped. He was forced to go down to avoid ALLRIGHTY and this was the only reason for his moving down. ALLRIGHTY did gallop out slightly but another runner, SOMERTON, was outside it. Mr May confirmed that there was no contact with ONE KENNY. Mr May stated that BALISTIC MISSILE was checked but he moved down to miss that runner. When ONE KENNY got up inside him, it got "a bit tight". Mr May said that, if he had stayed where he was, he would have been interfered with. ----Mr N G McIntyre, Stipendiary Steward, showed the incident on a head-on video replay. He showed the field racing to the first bend. He pointed out ALLRIGHTY break and check BALISTIC MISSILE on to ONE KENNY which broke. ----Mr White said that he lost "a bit of ground" but that it did not affect his chances as ALLRIGHTY had settled behind his horse. When questioned by Mr Escott, Mr White said that the interference did not help his chances. He confirmed that he had got tightened up and his horse galloped. ----Mr McPherson put it to Mr White that he was heading into the gap regardless of any interference. Mr White agreed and said that it was "general racing tightness" and he had eased to get on the back of Mr May who he could see was intending to move down. ----Mr McPherson was given the opportunity to give evidence and/or make a statement but declined to do so as did Mr Anderson, a part-owner of ALLRIGHTY, who was also present at the protest hearing. ----DECISION OF COMMITTEE --The Committee was satisfied, after hearing the evidence and viewing the video evidence, that there was interference caused by the breaking ALLRIGHTY which resulted in Mr May having to take evasive action and Mr White being put in a position where he could not avoid interference. The Committee was further satisfied that such interference affected the progress or chance of ONE KENNY. In the circumstances the protest was upheld and ALLRIGHTY was relegated to 9th placing in the Race. ----The Committee was reluctant to accept the evidence of Mr White that the interference may not have been caused by ALLRIGHTY and that the chances of ONE KENNY were not affected in the incident but preferred the evidence of Messrs May and McIntyre and the video evidence. The Committee noted that, prior to its breaking, ONE KENNY was working into a handy position and as a result of the break, lost considerable ground. ----The Committee was, therefore, satisfied that there had been interference to ONE KENNY when ALLRIGHTY broke and forced BALISTIC MISSILE down on to ONE KENNY causing that runner to break and lose ground affecting its chances. The Committee exercised its discretion to relegate ALLRIGHTY in those circumstances. ----Consequent upon the relegation of ALLRIGHTY, the amended placing for the Race are as follows; ----1st 3 Time Of Reckoning --2nd 1 Down Hill Racer --3rd 13 Ten To One --4th 11 Time to Go --5th 2 Simon's Sister ----
