Facts:
Following the running of Race 3, Rennell Grandkids Pace, an information was filed by Stipendiary Steward, Mr S W Wallis, against Licensed Open Horseman, Mr M P Edmonds, alleging that Mr Edmonds, as the driver of CASTELLANO in the race, “used his whip in an excessive manner over the concluding stages”.
Mr Edmonds was not present at the hearing of the information but he had signed the Statement by the Respondent at the foot of the information form indicating that he admitted the charge. Mr Wallis confirmed that Mr Edmonds had waived the right to be present at the hearing.
Rule 869 provides as follows:
(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.
Submissions for Decision:
Mr Wallis had Stipendiary Steward, Mr J M McLaughlin, show head-on and side-on video replays of the final 200-300 metres of the race. He pointed out CASTELLANO, driven by Mr Edmonds, racing outside the leader as the field approached the home bend. Mr Edmonds struck the horse twice at that stage before giving it some “respite”. In the run home, Mr Wallis alleged, Mr Edmonds used his whip a further 21 times. Mr Wallis alleged that the strikes were continuous and without any discernible pauses. All of the strikes were on the horse, Mr Wallis said.

Mr Wallis stated that Mr Edmonds has a clear record under the Rule. He had admitted the breach at the first opportunity. Although the strikes were on the horse, there was not a lot of force involved, Mr Wallis said. Mr Edmonds had explained to the Stewards that the horse was not one that could be hit hard but had to be urged along. The breach was no worse than mid-range, Mr Wallis said.
In the 2012/2013 season, Mr Edmonds had 133 drives and in the current season to date has had 15 drives. He drives mostly horses trained by himself but is a “reasonably busy” driver, Mr Wallis said.
Reasons for Penalty:
In determining penalty, the Committee had regard to the Penalty Guide which provides a starting point for a breach of the Rule of 6 drives or a fine of $300. Taking that starting point of a $300 fine (a fine being the appropriate penalty), the Committee was able to give Mr Edmonds a discount of $50 for his good record and a further discount of $50 for his admission of the breach. There were no other mitigating factors. The Committee assessed the circumstances of the breach to be in the mid range.
