Charge:
It was alleged that Mr M Kerr as the driver of “Major Talk” used his whip in an improper manner over the concluding stages when using his whip while his foot was out of the sulky footrest.
Mr Kerr advised the Stipendiary Stewards that he did not wish to be present for the hearing of this information.
Facts:
In the concluding stages of Race 3, Mr Kerr was racing in the one out and one back position. The video coverage of the race revealed that as Mr Kerr began the use of his whip, his foot came out of the footrest. He struck his horse 3 times with his foot out of the footrest, which the Stipendiary Stewards described as unacceptable. Mr Kerr told the Stewards, that he lost his balance momentarily, when he activated the sliding blinds, which was more or less simultaneous, with the commencement of his whip action.
Submissions for Penalty:
Mr Renault submitted that the fact situation was very similar to that of Open Horseman “S” who had appeared on a charge for a breach of this rule, approximately 3 weeks ago. In that case the driver concerned was fined $150, which Mr Renault submitted was appropriate in this case. He said that Mr Kerr had a good record, having appeared once in the last 12 months on a charge of excessive use of the whip.
Reasons for Penalty:
There were no aggravating features relating to this charge which would warrant an uplift on Mr Renault’s submission. The present case was very similar to the case involving the recent case in relation to Open Horseman “S” and thus we considered that we would not be justified, in the interests of consistency in imposing a different penalty.
