DECISION AND REASONS:

Following the running of Race 3, Dakins RAL Plastics Mobile Pace, an information instigating a protest was filed by Stipendiary Steward, Mrs K R Williams, against SHEZA BELMER (B Weaver), placed 3rd by the judge, on the grounds of interference to MILLWOOD ASHLEY (M P Jones) after approximately 200 metres.

Mr Weaver indicated that he represented the connections of SHEZA BELMER.

The start of the race had been delayed by approximately 6 minutes and there was a delay in the hearing commencing while parties and witnesses were summoned to the inquiry room. Consequently, the hearing of the information was not concluded prior to the start of Race 4.

Mrs Williams stated that the Stipendiary Stewards were alleging that Mr Weaver, who was attempting to improve onto the back of KIMMORLEY (J F Curtin) moved down and, in doing so, tightened MILLWOOD ASHLEY causing that horse to break. KOTARE JAGO (R P Nyhan) had been racing on the immediate outside of SHEZA BELMER at the time of the incident.

Mr B D Williams, Stipendiary Steward, showed video replays of the incident. He said that Mr Weaver appeared to be attempting to get onto the back of the leader, KIMMORLEY, shortly after the start. MILLWOOD ASHLEY, that had been racing on the pylons, appeared to run out of room, stumbled and broke. Mr Williams said that, at the point that contact was made, it appeared that KOTARE JAGO was a head to half a neck behind SHEZA BELMER as MILLWOOD ASHLEY was tightened. Mr Weaver also appeared to be angling in before KOTARE JAGO got alongside. Mr Williams stated that KOTARE JAGO had its head turned and was shifting in. MILLWOOD ASHLEY had run out of room but it was difficult to say how much influence KOTARE JAGO had on that although it would be difficult for Mr Nyhan to influence Mr Weaver's line coming from behind him.

Mr Weaver pointed out on the video that he was angling across and then noticed that Mr Jones was on his inside. He then straightened his horse when Mr Nyhan "comes down on top of me", he said. It was apparent from looking at his horse's head, he said. SHEZA BELMER was actually running out, Mr Weaver said. Mr Nyhan said that he had simply followed Mr Weaver down and had no bearing on Mr Weaver's line.

Mr Jones said that he had got through from the second row and was attempting to get on KIMMORLEY's back. Mr Weaver had been one?off and he had decided to get up on Mr Weaver's inside. He heard Mr Weaver call out and he, Mr Jones, attempted to ease out of the gap but was not quite able to do so. He touched the wheel of Mr Weaver's sulky. He said that Mr Weaver had the opportunity to get on Mr Curtin's back right up to the time when he heard him call out. He was not able to say whether Mr Weaver was being put under pressure or not. He said that Mr Nyhan may have got slightly ahead of Mr Weaver prior to the incident.

Mr Weaver alleged that Mr Nyhan's wheel had been level with his wheel and Mr Nyhan had therefore been able to push him down. He stated that he had not been able to get onto Mr Curtin's back because his horse was hanging out. Mr Nyhan's horse was hanging all over him, Mr Weaver stated. Mr Weaver said that SHEZA BELMER wears a pole on the off side. He could have got into the trail long before he did had it not been hanging out. He alleged that the head of his horse could be seen to turn when Mr Nyhan had come down on top of him and he pointed this out on the video replay.

The Committee, in a brief interim decision, stated that it was not satisfied that Mr Nyhan had contributed to the incident and accepted that he was always behind Mr Weaver. That left the conclusion that Mr Weaver and his horse were at fault. However, there was sufficient doubt for the Committee, in this case, there being no true head-on video replay and the two side-on replays being of limited assistance. The Committee was left with a doubt so the protest was dismissed.

There did appear to be interference suffered by MILLWOOD SUCCESS after approximately 200 metres of the race. However, it was not possible to say with any certainty what the reason was for that horse's going off stride as the evidence given by the parties and the witnesses was conflicting and difficult to reconcile. Furthermore, the video evidence was, in the Committee's view, inconclusive. It was not possible for the Committee to be satisfied that the interference had been caused by SHEZA BELMER to warrant a change in the placings for the race.
