It was alleged that as the driver of "Benihana", that Mr Reardon used his whip excessively in the straight.
Facts:
Following the running of the "Bishopdale & Bush Inn TAB's Amateur Drivers Mobile Pace", Mr J Reardon was charged with breaching Rule 869(2)(a) of the Rules of Harness Racing. In this case the Stipendiary Stewards alleged that Mr Reardon's use of the whip was excessive.
Mr Wallis demonstrated the incident that he complained of, using video coverage from the turning point for home to the winning post. Mr Wallis' estimate was that Mr Reardon hit his horse about 29 times, with the early strikes of the whip being in quick succession and with a rein in his whip hand. In the finishing stages, Mr Wallis said that Mr Reardon hit his horse 3 or 4 times with some force.
Mr Reardon did not take issue with the allegations and acknowledged that he got a "bit keen". He asked that the Committee take into account the fact that whilst his early strikes were "rapid fire", that he had the rein in his hand, and he was not hitting his horse with any degree of force.
Submissions for Penalty:
Mr Wallis said that Mr Reardon was new to the Amateur Drivers' ranks, and had not come to the attention of the Stipendiary Stewards before. He submitted that a fine of $200 was appropriate.
Mr Reardon considered that a fine of $200 seemed reasonable.
Reasons for Penalty:
The starting point for the imposition of penalty in terms of the Penalty Guide for a first breach within a year is a fine of $300 or a suspension of 6 drives. We then look to aggravating and mitigating factors in setting penalty.
In this case there were no aggravating features which would warrant an uplift on the starting point. There are mitigating factors, in that Mr Reardon admitted the breach at an early opportunity, and is quite new to the Amateur Drivers' ranks. Those factors allow us to afford a discount of $100 on the starting point.
