Facts:

Following the running of Race 8, The Worlds Fastest Indian Mobile Pace, an information Instigating a Protest was filed by Stipendiary Steward Mrs K R Williams alleging interference by “Galleons Ambition” (2) driven by Mr K G Cameron to “Jackaroozy” (14) driven by Mr R W Todd.

The Information reads as follows.

--

“This is a protest against horse number (2 ) placed 3rd  by the Judge on the grounds of interference.  The interference occurred with approx. 500m to run when GALLEONS AMBITION shifted out for a run resulting in JACKAROOZY breaking & checking other runners.”

Rule 869(8) provides as follows.

--

“The Judicial Committee may in addition to any other penalty which may be imposed pursuant to Rule 1003 thereof place any horse which:

--

 

--

(a) may have gained an advantage by any conduct or interference prohibited by any preceding provision of this Rule and/or

--

(b) may have interfered with, or whose horseman may have interfered with, the progress or chance of any other horse or horses, -

--

immediately after any horse from which it may have gained an advantage or whose chances or progress may have been affected thereby.”

Submissions:

--

Mrs Williams gave evidence and used video coverage to show that with about 500 metres to run “Jackaroozy” was making a forward move.  At this time “Galleons Ambition” was in the one out and one back position (the “one one”), and it slowly and gradually moved outwards.  Improving three wide at this time was “Jackaroozy”, and Mr Todd had advised the Stipendiary Stewards that there was contact between the sulky wheel of “Galleons Ambition” and the hind leg of his horse which broke and lost its chance.  There were resultant checks to other runners.

Mr Todd gave evidence that this incident was caused when “Galleons Ambition” made a slight movement out.  There was then a noise, and his horse broke. Mr Todd said the noise “sounded like he touched me”.  Mr Todd agreed that Mr Cameron had not moved out sharply, but said that Mr Cameron was not in a position to move him wider.

Mr A M Butt was also called to give evidence.  Mr Butt was driving “Exposed” (11) in this race and at the time of the incident he was racing in the one out and three back position and trailing “Galleons Ambition”.  Mr Butt said that Mr Cameron moved out very gradually and that he had done “nothing wrong” when making this move.  Mr Butt also said that he expected Mr Cameron would be making his move outwards at about this time.

Mr Butt also said that “Galleons Ambition” was well out by the time “Jackaroozy” drew alongside, and that he thought “Jackaroozy” was hanging in a little at the time of the incident, and that this probably contributed to the incident.

After hearing the evidence from Mr Butt Mrs Williams advised that the Stipendiary Stewards no longer supported the protest, but that Mr Todd had the option of carrying on with it if he wished.

We then asked Mr Todd if he wished to carry on with the protest and he said that he did not.

--

Decision:

--

 We then advised the parties that this protest was dismissed, and that the Judge’s placings stood.   Mrs Williams then advised the TAB that the protest had been dismissed, and she authorised the payment of dividends according to the Judge’s placings.
