As Mr Smith has admitted the charge it is deemed to be proved.

Mr Smith is fined $250.00.

Facts:

Prior to the running of Race 4, "The Rangiora HRC Trainer of the Year 2014/2015 Robert Dunn Pace", Co-Chief Stipendiary Steward N McIntyre, observed that "Living Glory" trained by Mr G Smith, Licensed Trainer/Driver, was fitted with an unapproved rearing strap, as it had prickers attached. The regulations clearly state that any rearing strap must be fully taped, but that prickers are not permitted. As a consequence the rearing strap was removed before the race.

The hearing was advised that Mr Smith did not wish to be present when the information was presented for consideration.

Submissions for Penalty:

Mr Tidmarsh said that the last time a trainer had been charged with a similar breach was in 2008, and prior to that 2006. Both trainers  were fined $200.00. He further said that Mr Smith had not been charged with such a breach before, and that animal welfare was not an issue.

He submitted that a fine of $200.00 would be appropriate.

Reasons for Penalty:

There is no reference in the penalty guide to this kind of breach. Neither is there in the penalty data base, any reference to a similar breach. However, having regard to the fact that the last breach of this kind was in 2008, and the fact that there has been an overall upwards movement in penalties generally of recent times, this committee is of the view that there should be an increase on the fines imposed in 2006 and 2008.
