The protest was upheld and CARIBBEAN FIZZ was relegated from 4th placing to 6th.

Consequent upon the relegation, the amended result for the race is as follows:

1st 6 Imran Khan
2nd 7 Bright Glow
3rd 9 Honey Sun
4th 11 Fira Sunset
5th 8 Sage Trouble

It was ordered that dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of race 2, the Matt Blair Motors Trot, an information instigating a protest was filed by Stipendiary Steward, Mr S Wallis, against (12) CARIBBEAN FIZZ (M Williamson), placed 4th by the judge, on the grounds “that horse 12 was not in its correct gait at the finish line and was lapped on by horses 8 & 11.”

Mr M Williamson driver of CARIBBEAN FIZZ, had endorsed on the information form and signed “I do not contest the protest”. Mr Wallis confirmed that Mr Williamson did not wish to be present at the protest hearing.

The official placings for the race were:

2nd 7 Bright Glow
3rd 9 Honey Son
4th 12 Caribbean Fizz
5th 11 Fira Sunset

Rule 870 provides as follows:

(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then ( subject to Rule 869A such relegation of the horse shall be at the discretion of the Judicial Committee.

Submissions for Decision:

Mr Wallis showed the race video replay of the final 100 metres of the race.

He identified CARIBBEAN FIZZ, driven by Mr Williamson, finishing the race in the middle of the track and thereafter at approximately 40 metres from the finish, galloped, free of interference, and continued on in a gallop past the finishing line, finishing in 4th placing.

Mr Wallis then froze the video at exactly the finishing post and pointed to (12) CARIBBEAN FIZZ and the two lapped on horses which were (11) FIRA SUNSET and (8) SAGE TROUBLE. He informed the Committee the Judge's margin was 1.9 lengths.

Mr Wallis submitted that the horse had galloped for approximately 40 metres. He sought relegation of CARIBBEAN FIZZ from 4th placing to 6th.

Reasons for Decision:

The Committee was satisfied that CARIBBEAN FIZZ had broken from its gait, free of interference, approximately 40 metres from the finishing line and had continued on in a gallop past the finishing line, being placed 4th by the Judge.

The Committee were also satisfied that CARIBBEAN FIZZ had been lapped on by FIRA SUNSET and SAGE TROUBLE therefore in breach of Rule 870 (5) and the Breaking Horses Regulation.

The Committee noted that Mr Williamson did not contest the relegation of CARIBBEAN FIZZ.
