Charge:

 Breach of Rule 869(5)-Half carting.

Facts:

Following the running of Race 2, the “Glenferrie Farm” Four & Five Year Old Trotting Mares Series Prelude, an Information was filed by Stipendiary Steward Mr M N Ydgren against Open Horseman Mr J C Hay, the driver of “The Real McGuire” (7), alleging a breach of Rule 869(5) in that he half carted for some time from near the 1600m.

The charge reads as follows:

I the above named Informant allege that the above named Respondent committed a breach of Rule 869(5) in that you half carted for some time near the 1600m when driving “The Real McGuire”.

Rule 869(5) reads as follows –

“(5) A horseman shall trail with his horse’s head behind the seat of the sulky being trailed.”

Submissions for Decision:

Mr Hay confirmed to the Committee that the breach was admitted and that he understood the Rule that he was being charged with.

Mr Ydgren gave evidence and used video coverage to show that near the 1600m Mr Hay, driving “The Real McGuire”, positioned his horse on the outside of “Royearl Quest’s (B Orange) wheel and had  maintained this position for too long.

Mr Hay submitted that the effect on other runners was minimal and that the half carting was at the lower end of the scale.

Reasons for Decision:

As Mr Hay had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).

Submissions for Penalty:

Mr Ydgren submitted that Mr Hay should be given credit for his frank admission of the breach and that the JCA penalty guide showed a starting point of $200 for a breach of this Rule. He also stated that Mr Hay had a clear penalty record under this Rule and submitted that a fine of between $150 and $200 be considered.

Reasons for Penalty:

We were satisfied, after taking into consideration Mr Hay’s frank admission of the breach, his clear penalty record, and penalties imposed for similar breaches of this Rule, that a fine of $150-00 was an appropriate penalty in this case.
