DECISION AND REASONS:
--Following the running of Race 7, the Floorpride Rangiora Handicap Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr J. F. Curtin, Open Horseman, driver of "Bad Bad Boy" (10), alleging a breach of Rule 857(7)(a) and (b). The charge reads as follows.
--------"I, the above named informant allege that the above named Defendant committed a breach of Rule 857(7)(a) and (b) in that Mr Curtin charged the start causing a false start despite the instructions of starter P. Lamb."
--The Rule reads as follows.
--"(7) No horseman shall:-
--- ------
- delay the start; --
- fail to obey the Starter's instructions;"

Mr Curtin had indicated on the Information that he did not admit this breach of the Rules, and he confirmed this at the hearing. Mr Curtin also confirmed that he understood the nature of the charge and the Rule.
--Mr Escott called Starter Mr Lamb to give evidence, and he said that he had called the field into line, and that they were in the process of lining up when several of the outside horses on the front line moved forward and hit the barrier strand which broke. A false start was declared.

It was also established from Mr Lamb's evidence that he had not asked the horses to walk forward ("move up") and that he was not ready to effect the start by saying "right". Mr Lamb also said that when this incident occurred he was saying "whoa whoa whoa".
--Stipendiary Steward Mr Ydgren said that he was stationed in the tower at the top of the front straight and could clearly hear Mr Lamb's instructions to the drivers.
--He heard instructions for the horses to turn around and stand. He said that the outside group moved forward and gained momentum resulting in the barrier strand being broken and a false start declared. Mr Ydgren also said that his attention was drawn to the incident because of the speed the horses were moving forward.
--Video coverage of this incident was used to show that there were 10 horses drawn to start on the front line. The five inside horses appeared to be standing still, but the outside five horses moved forward quite quickly as a group resulting in the barrier strand breaking.
--Mr Curtin asked Mr Lamb if he said it was looking "pretty good". Mr Lamb did not recall saying this, although he could not be sure that he did not. He also asked Mr Ydgren how he was able to hear what Mr Lamb was saying from his position in the tower. I accept that Mr Ydgren was able to hear what was said.
--Mr Curtin gave evidence that he was under the impression that a start was ready to be called, and that Mr Lamb had said that it was looking "pretty good".
--Mr Curtin did not dispute that Mr Lamb had not asked the horses to walk forward, or indicate a start by saying "right".
--I then adjourned to consider my decision. From the evidence I was satisfied that the accepted procedure for starting a standing start race is for the Starter to tell the drivers to form up in their correct positions. He then tells the drivers to "move up" or "walk forward" and, if all is in order, he then starts the race by saying "right".
--I was satisfied that there were no instructions from the Starter to move forward, and that he was not ready to indicate a start.
--On resuming the hearing I advised that a full written decision would be given later, and I gave the following oral decision.
--"Having heard the evidence and having seen the video coverage I am satisfied that Mr Curtin was driving "Bad Bad Boy" (10) which drew 9 of 10 on the front line. At the start several horses on the front line moved forward quite quickly and broke the barrier strand causing a false start.
--Mr Lamb gave evidence that he had called the horses into line but had not indicated a start when this incident took place. The video coverage shows that only the outside horses moved forward as a group.
--Mr Curtin's defence was that Mr Lamb had said they were looking "pretty good" and took this as an indication to move forward.
--I find that an instruction was given by Mr Lamb to prepare for a start but that Mr Curtin anticipated that Mr Lamb would start the race. He did not and I find the charge proved."
--Penalty: Mr Escott recommended a fine of $50-00 for this breach and Mr Curtin accepted that this was reasonable. I found that the fine recommended was appropriate and Mr Curtin was fined this amount.
