Following the running of Race 4, the PlaceMakers Cranford St Dewalt Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr L. F. O?Reilly, the driver of "Last To Pass" (3), alleging that Mr O?Reilly had committed a breach of Rule 869(4)

DECISION AND REASONS:

Following the running of Race 4, the PlaceMakers Cranford St Dewalt Mobile Pace, an information was laid by Chief Stipendiary Steward Mr N. R. Escott against Mr L. F. O?Reilly, the driver of "Last To Pass" (3), alleging that Mr O?Reilly had committed a breach of Rule 869(4) in that with approximately 1000 metres to run, when improving his position outwards, he caused a check to "Louisianna Blue Jean"(6) driven by Mr S. McNally.

The defendant indicated on the information that he admitted this breach of

the rules, and he confirmed this at the hearing. It was also agreed that the evidence from the protest hearing would be accepted in relation to this hearing. The breach occurred at the 1000 metre mark when Mr O?Reilly moved outwards suddenly and made contact with "Louisianna Blue Jean" which broke.

PENALTY: Mr Escott advised that Mr O?Reilly had no previous relevant convictions, and that he should be given credit for his guilty plea. A fine of $250-00 was recommended. Mr O?Reilly had no submissions to make regarding penalty. After considering the matter we were satisfied that a fine of $250-00 was appropriate in this case and Mr O?Reilly was fined this amount.
