The Information alleges that near the 300 Metre Mark Ms S Spratt permitted her mount to shift out when not clear of VERCORS (M Walker) forcing that runner into the line of IRLANDA (M Coleman) who was checked.

Miss Spratt was present at the hearing together with her employer Mr R Yuill.

--

Miss Spratt admitted the breach.

--

The rule was read and both Miss Spratt and Mr Yuill acknowledged they understood same.

The Committee were then shown a film of the alleged incident which was demonstrated and interpreted by Chief Stipendiary Steward Mr C George.

--

 

--

Miss Spratt and Mr Yuill were then both given the opportunity to give their interpretation of the film or ask any questions of Mr George.

--

 

--

Miss Spratt for her part felt M Walker’s horse may have over reacted.

--

 

--

Mr Yuill did not wish to make any comment.

--

The Committee then heard submissions as to penalty from Mr Oatham.

--

 

--

Mr Oatham told the Committee the Stewards were concerned with Miss Spratt’s record which showed she had been in breach of this rule 7 or 8 times in the last 12 months.  The most recent breaches and penalties were as follows:

--

27.12.07 4 days; 23.1.08 5 days; 29.2.08 6 days and 1.3.08 2 weeks and $4000 fine.  He also stressed that on this occasion two horses had been affected and it was a “Group One” race.

He felt the breach warranted a 3 to 4 week suspension together with a substantial fine.

--

 

--

Miss Spratt again said she felt M Walker’s horse had over reacted and no contact had been made.

--

 

--

Mr Yuill for his part felt the submissions as to penalty were “steep” as he felt no horse had been cost any monies by Miss Spratt’s horse.

--

 

--

When asked by the Committee if a deferral of any suspension was requested Mr Yuill said,  no, he would prefer it to start after the conclusion of racing on Sunday the 6th of April.

--

The Committee being happy, all parties had aired their views, retired to consider penalty.

--

 

--

When considering penalty the Committee took into account submissions from both parties and the fact that to her credit Miss Spratt had admitted the breach and credit must be given for that.

--

 

--

They were however concerned at her record which to say the least was not good, also that two horses had been affected by her permitting her mount to shift out when not sufficiently clear which the film clearly showed, they also took into account that the incident happened in a “Group One” race which was being run for a stake of $220000.00 and that this was only her fourth day back riding after suspensions.

--

Taking into account all of the foregoing the Committee felt a suspension of one month and a fine of $5000.00 was appropriate.

--

When the penalty was delivered Mr Yuill was not present as he was away saddling a horse for a later event.  He had told Miss Spratt of this and that they were both happy the penalty was delivered in his absence.

The suspension is to start at the conclusion of racing on the 13th of April 2008 and end at the conclusion of racing on 13th of May 2008.

--

Mr Yuill had approached the Stewards and requested this on Miss Spratt’s behalf as he had earlier made a mistake when not asking for deferral, the Stewards nor the Judicial Committee had a problem with the deferral.
