Following Race 2 an information was filed by Stipendiary Steward Mr A Coles, pursuant to Rule 876(1), alleging that DURANGO KID placed first by the judge interfered with the chances of TAZIO placed third by the judge.

DECISION AND REASON

--

Following Race 2 an information was filed by Stipendiary Steward Mr A Coles, pursuant to Rule 876(1), alleging that DURANGO KID placed first by the judge interfered with the chances of TAZIO placed third by the judge. The interference occurred in the final straight.

Mr Coles reserved the right to charge Mr A Calder, rider of DURANGO KID.

Mr Coles advised that the margins were half a length, with a long neck between second and third.

--

Mr Oatham demonstrated the relevant films which showed at the 200 metre mark DURANGO KID ridden by Mr A Calder, move out 2-3 horse widths before straightening, and in the process dictated the line of TAZIO ridden by Ms L Cropp, for a short distance.

Ms Cropp said she was making a winning run and the movement definitely cost her second place.

Mr A Calder, rider of DURANGO KID, asked Ms Cropp if contact had been made, to which she answered "No". He then demonstrated the film where he alleged that:

  1. TAZIO was showing a tendency to move outwards before the incident.

    --

  3. Ms Cropp did not stop riding at any stage.
  4. --

    --

  5. At the line TAZIO was not making ground on the second place horse SHARP DEAL.

After again looking at the films and considering the evidence the committee concluded that:

  1. DURANGO KID did cause some interference to TAZIO.
  2. --

  3. TAZIO did show a tendency to run out before the incident.
  4. --

  5. Ms Cropp did not at any stage stop riding TAZIO.

Although we find that interference did take place, we exercise our discretion and dismiss the protest because we believe that the movement was not enough to deny TAZIO finishing in a better place, taking into account the judge's margin. We therefore declare that the judge's placings stand.
