Following race 4 an Information was filed pursuant to Rule 866(1)(c). The informant, Mr J Oatham, alleged that Mr C Leveque, rider of JUDDERBAR, failed to ride his mount out to the end of the race when there was a reasonable chance of running second.

Mr Leveque admitted the breach.
Mrs Whiteside, trainer of JUDDERBAR, was also present in case of language problems as Mr Leveque is French.
Mr M Williamson demonstrated the video films which showed Mr Leveque riding forward and using the whip while running a clear second coming up the straight. Approximately 5 – 6 strides before the post it was noticeable that Mr Leveque changed his riding style by standing up in the saddle which enabled TUI KAHA to pass him just prior to the post and finish a short head of JUDDERBAR.
--Mr Oatham said it was obvious Mr Leveque had relaxed some 5 – 6 strides before the post which enabled TUI KAHA to pass him. He said he had JUDDERBAR vetted and he appeared normal so the blame lay with Mr Leveque.
--Mr Leveque admitted he relaxed just prior to the line and it was an error of judgement on his part.
--PENALTY SUBMISSIONS:
Mr Oatham said there were some mitigating factors in Mr Leveque’s favour, namely that his mount was tiring and the position of the winning post at Te Aroha was close to the bend and often caused confusion. He said TUI KAHA finished very fast which Mr Leveque was unaware of until close to the line. However, he said the Committee should consider the loss to punters and the loss of stakes to the owners of JUDDERBAR. He submitted a 3 – 4 week suspension was appropriate.
Mr Leveque said he had commitments on 18 April 2009.
--PENALTY:
The Committee considered all submissions, in particular the following:
1. Mr Leveque’s guilty plea.
2. Mitigating factors described by Mr Oatham which the Committee concurs with.
3. The loss to punters and connections of JUDDERBAR.
The Committee pointed out to Mr Leveque his obligations under the rule before imposing penalty. Accordingly we impose a suspension on Mr Leveque from riding in races from after racing on 18 April 2009 and conclude after racing on 13 May 2009.
