Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that C Ormsby, rider of HE CAN TANGO, committed a breach of that Rule

DECISION & REASON:
--Following race 4 an information was filed pursuant to Rule 871(1)(d) when it was alleged by the informant, Stipendiary Steward Mr J P Oatham, that C Ormsby, rider of HE CAN TANGO, committed a breach of that Rule when shortly after the start he angled his mount inwards dictating RITZY LADY (A Calder) inwards causing severe tightening to SHANGHAI DEVIL (L Cropp).
--Mr Ormsby, who was represented by Mr L O?Sullivan, admitted the charge.
--Mr W Robinson demonstrated the video which showed Mr Ormsby, soon after the start, start a gradual movement inwards. This movement dictated the line of RITZY LADY and SHANGHAI DEVIL until the horses ran out of room and as a consequence both suffered interference. In SHANGHAI DEVIL?S case it was severe.
--As the charge was admitted the only judgement to make is on penalty.
--Mr Oatham gave Mr Ormsby's record over the last 18 months which included 4 previous charges. He said he felt that this offence was at the higher end of the scale and therefore asked for a suspension.
--Mr O?Sullivan asked that we consider Mr Ormsby's record over the last 12 months when only one careless riding charge had been preferred. He also mentioned Mr Ormsby's admission of this charge.
--After taking all matters into account we agree that this offence is of a more serious nature. We have also taken into account Mr Ormsby's record and his admission of the charge. Accordingly we suspend Mr Ormsby from the conclusion of racing on 4 January until the conclusion of racing on 18 January 2006 ? 5 days.
