--Following Race 6 an Information was filed pursuant to Rule 871(1)(d), when it was alleged by Mr George that near the 200 metre mark Mr A Peard, rider of KILMARNA, allowed his mount to shift in for a run, dictating MISS PANUI

Following Race 6 an Information was filed pursuant to Rule 871(1)(d), when it was alleged by Mr George that near the 200 metre mark Mr A Peard, rider of KILMARNA, allowed his mount to shift in for a run, dictating MISS PANUI (N Harris) inwards causing a check to TARBACH (R Norvall) who made contact with the running rail.
--Mr Peard did not admit the charge.
--Mr Robinson demonstrated the video films and showed Mr Peard moving inwards for a better run soon after entering the home straight. In doing so, he dictated the line of MISS PANUI (N Harris) who as a result was forced across onto TARBACH (R Norvall) who had to be checked as a result. Mr Peard was not the required distance clear at any stage.
--Mr George said in his statement that Mr Peard allowed his mount to move in and not leave enough room for Mr Norvall. He said Mr Norvall was in the gap inside Mr Harris, but such was the pressure received from the outside he had no option but to check his mount. He said Mr Peard should have been three off the rail instead of the 2-1/2 horse widths, which Mr Peard conceded.
--Mr Peard said in his statement that soon after entering the straight he angled his mount in for a better run, but in his opinion, at the same time Mr Harris also rolled in which also contributed to the interference received by Mr Norvall.
--Decision:
--The committee is clearly of the opinion that the check received by Mr Norvall was caused by Mr Peard putting pressure onto MISS PANUI (N Harris), who in turn was forced to move inwards and put pressure on TARBACH (R Norvall). Mr Peard was not the required distance clear at any stage. Accordingly the committee found the charge proven.
--Penalty:
--Mr George produced Mr Peard's record showing only one suspension in the last 12 months. However, he believed a suspension of 3-5 days was appropriate.
--Mr Peard asked the committee to consider his excellent record.
--The committee considered all submissions and also believed a suspension was the correct penalty. Accordingly, Mr Peard was suspended from the conclusion of racing on the 28th March 2007 and concluded after racing on the 5th April 2007 (4 days).
