CHARGES:

Following race 3 an Information was filed pursuant to Rule 638 (3)(b) by the Informant Mr Williamson.  He alleged that Mr P Turner used the whip excessively on his mount KARIN’S KEEPER.

FACTS:

--

Mr Oatham demonstrated the video films which clearly showed Mr Turner (KARIN’S KEEPER) strike his mount approximately seventeen times between the 350 metres and the 200 metres.  Mr Oatham said this was clearly outside the guidelines and Mr Turner only gave his mount a respite of three strides during that period.

Mr Turner had nothing to say when asked.

SUBMISSION(s) ON PENALTY:

--

Mr Williamson said Mr Turner clearly had a problem with his use of the whip having incurred two charges in August and September last year when he was fined $500 on each occasion.  Mr Williamson submitted a fine of not less than $500 would be appropriate.

Mr Turner conceded he did not have the best whip record but he had been trying hard to improve and this was his first charge this year.

REASON(s):

--

The Committee considered all evidence and submissions and voiced their concern to Mr Turner over his use of the whip.  However we concede that Mr Turner has been trying hard with improvement evident until today.  For this reason we do not believe an increase in the penalty imposed on him last time is necessary.

PENALTY:

--

Accordingly after taking the above facts into account we impose a fine of $500.
