Following the running of Race 7, the Amcor Kiwi-LRK Trays Kiwifruit Cup, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 520(4)(c) alleging that Apprentice Jockey Mr B. R. Lammas failed to make the handicapped weight for “Biggles” (10).

Following the running of Race 7, the Amcor Kiwi-LRK Trays Kiwifruit Cup, Chief Stipendiary Steward Mr R. Sanders filed an information pursuant to Rule 520(4)(c) alleging that Apprentice Jockey Mr B. R. Lammas failed to make the handicapped weight for “Biggles” (10).
--Mr Lammas had indicated on the Information that he admitted this breach of the Rules, and he confirmed that at the hearing. Mr Lammas also agreed that he understood the charge and the Rule it was brought under.
--Mr Sanders gave evidence that Mr Lammas was engaged to ride “Biggles” at the carded weight of 52.5kg. However it was found that he was .75kg overweight, which is .25kg more than the allowable overweight under the Rules. Because of this Mr Lammas had to be replaced as the rider of “Biggles”.
--Mr Lammas gave evidence that when he found out that he was down to ride “Biggles” he spoke to the trainer, Mr Adams, and told him that he would be unable to make the carded weight. The matter was discussed and Mr Adams said that he could ride “Biggles” at .5kg overweight, which was permitted by the Rules. Mr Lammas said that he then confirmed the ride as he believed that he would be able to get his weight down to 53kg. Mr Lammas said he tried his best to make this weight, but failed.
--Penalty:
--In relation to penalty Mr Sanders said that Mr Lammas had a previous conviction under this Rule on 21 March 2009 when he was fined $200-00. Both this race, and one at Christchurch on 21 March last were listed races. Mr Sanders also said that it should be taken in to account that Mr Lammas had admitted the breach, and that his previous record was good. A fine of no less than $200-00 was recommended.
--Mr Lammas had no submissions to make regarding penalty.
--We adjourned to consider the matter of penalty. We were satisfied that although Mr Lammas had a previous conviction, the circumstances of this breach were that he had recognised that his weight could be a problem and spoke to the trainer. He was within .25kg of making the weight. We were satisfied that the minimum fine recommended by Mr Sanders was fair in the circumstances, and on resuming the hearing the parties were advised that Mr Lammas was fined the sum of $200-00.
