Following Race 9 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that Mr C Parish, rider of AGA KHAN, allowed his mount to shift inwards near the 600 metres.  He further alleged that Mr Parish was not sufficiently clear of MANGAROA MOLLY (D Johnson) which was forced into the line of UNCLE DONALD (T Thornton) causing that runner to be checked.

Following Race 9 an Information was filed pursuant to rule 638 (1) (d).  The Informant, Mr Coles, alleged that Mr C Parish, rider of AGA KHAN, allowed his mount to shift inwards near the 600 metres.  He further alleged that Mr Parish was not sufficiently clear of MANGAROA MOLLY (D Johnson) which was forced into the line of UNCLE DONALD (T Thornton) causing that runner to be checked.

Mr Parish did not admit the breach.

Mr Oatham demonstrated the video films and showed that at a point near the 600 metres, Mr Parish riding AGA KHAN was racing in a position 4 off the rail.  He was following RAFFINE (C Grylls) who did appear to be over racing. Mr Oatham showed Mr Parish directing his mount in to gain a better run and away from Mr Grylls.  This inward movement caused MANGAROA MOLLY (D Johnson) to also move in and into the line of UNCLE DONALD (T Thornton) who received a severe check.  Mr Oatham conceded that Miss Johnson’s mount was running greenly which did play a part in the check to UNCLE DONALD.

Mrs T Thornton was called to give evidence and confirmed to the Committee she did receive a severe check from Miss Johnson.  She said she was racing ¾ of a length behind that runner and was aware the check she received was caused by pressure from the outside.

Miss D Johnson, rider of MANGAROA MOLLY, was called and stated she was following Mr Parish and went for a run on his inside.  She admitted her mount was racing greenly but said Mr Parish had rolled in causing her mount to move further in, thereby interfering with Mrs Thornton’s mount.  She said it was a bit of both – her mount’s greenness and Mr Parish rolling in which caused the trouble.

Mr Parish, rider of AGA KHAN, said that he was receiving pressure from Mr Grylls ahead of him and had to check to avoid his heels.  He said his horse was a first starter but said that even when he did roll in slightly there was a gap between his mount and MANGAROA MOLLY.  He believed it was the greenness of Miss Johnson’s mount which caused the trouble.

Mr Coles, in summing up, said it was clear on the films that Mr Parish had shifted in from his 4 wide position and dictated the line of Miss Johnson when insufficiently clear of that runner.

DECISION

--

The Committee carefully considered all the evidence and reviewed the video films.  We are clearly satisfied that Mr Parish did allow his mount to move in and dictate the line of MANGAROA MOLLY.  Although we concede there was a gap between AGA KHAN and MANGAROA MOLLY we are satisfied that if Mr Parish had kept a straight line Mrs Thornton would not have received the check she did.  However the whole incident was accentuated by MANGAROA MOLLY racing greenly and overacting somewhat when Mr Parish rolled in.

For the above reasons and namely that Mr Parish was not the required distance clear of Miss Johnson when shifting in we find the charge proven.

PENALTY SUBMISSIONS

--

Mr Coles said Mr Parish had a good record with 2 suspensions this season – 5 September 09 (4 days) and 12 December 2009 (5 days).  There were mitigating factors in this charge and believe Mr Parish’ carelessness was at the lower end. 

--

Mr Parish said he had commitments at Ruakaka on 5 January 2010 and did intend riding in the South Island in the coming week.

PENALTY

--

The Committee considered all evidence and submissions before imposing an appropriate penalty.  Mitigating factor in this charge is the over reaction of MANGAROA MOLLY.  However as stated above Mrs Thornton received a severe check partly caused by Mr Parish.

Accordingly we impose a suspension which is to start after racing on 5 January 2010 and conclude after racing on 9 January 2010 (4 days)
