Following Race 7 a protest was lodged pursuant to rule 642 (1).  The Informant Mr D Walsh, rider of the 4th placed horse, GENDARME, alleged that ELLEYECEE, placed 3rd by the Judge, caused interference to his mount in the final straight.  The margin at the post between 3rd and 4th was a short neck.

Following Race 7 a protest was lodged pursuant to rule 642 (1).  The Informant Mr D Walsh, rider of the 4th placed horse, GENDARME, alleged that ELLEYECEE, placed 3rd by the Judge, caused interference to his mount in the final straight.  The margin at the post between 3rd and 4th was a short neck.

Mr Walsh demonstrated the video films and pointed out to those present that soon after turning for home he was racing in a 3 off position at the rear of the field.  Approaching the 200 metres a gap presented itself on the inside of ELLEYECEE (S Collett).  Mr Walsh said as he entered the gap ELLEYECEE changed ground and moved in sharply taking his line.  He said this resulted in him losing momentum for a stride or so.  He said he was going to beat ELLEYECEE by a neck or two.

Mrs Herbert, trainer of GENDARME, confirmed what Mr Walsh had said and believed it cost GENDARME momentum.

Mrs Hobson had nothing to add.

Mr Richardson stated the 2 horses did not brush and believed it was similar to an Ellerslie protest and asked for consistency.

Mr Tisch said the interference was very close to the line and he did not believe GENDARME would have beaten ELLEYECEE.

Miss Collett said there was a gap for Mr Walsh for long enough if his mount had been good enough.  She felt she had lost some momentum when she had to take corrective action.

Mr Coles said it was clear there had been movement by ELLEYECEE which caused Mr Walsh to stop riding for one stride.  He said the Committee would have to decide if this cost GENDARME more than a short neck.

Mr Walsh, in summing up, said momentum is a huge factor which is difficult to quantify.

DECISION

--

The Committee carefully considered all the evidence and reviewed the video films.  We are clearly satisfied that GENDARME did have his momentum affected when finishing very strongly from the back of the field.  It was clear this was caused by ELLEYECEE moving in sharply when insufficiently clear of GENDARME.  When GENDARME was rebalanced he continued to finish very strongly and taking ground off ELLEYECEE in the run to the post.  Accordingly we are satisfied that if interference had not occurred GENDARME would have beaten ELLEYECEE.

Therefore the protest is up held and the placings shall now be:
1    ALL IN TEMPO  1st
10  COSMIC GIRL  2nd
3    GENDARME  3rd
8    ELLEYECEE   4th
14  PROMACE  5th
