Decision:

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Mr C Lammas permitted his mount (Casual Fibs) to shift inward near the 200 metres when not sufficiently clear of ‘Popsicle’ who was crowded onto ‘Pocket Diary’ (M Wenn).

Following Race 1 an Information was filed pursuant to Rule 871 (1) (D). The Informant Mr J Oatham alleged that Mr C Lammas permitted his mount (Casual Fibs) to shift inward near the 200 metres when not sufficiently clear of ‘Popsicle’ who was crowded onto ‘Pocket Diary’ (M Wenn).

Mr Lammas admitted the breach.

As the Committee had viewed the films relating to the interference several times in Miss Collett’s charge, Mr Oatham showed the Committee Mr Lammas move in approximately 1 horse width and into the line of ‘Popsicle’ (T Thornton) who in turn buffeted ‘Pocket Diary’ (M Wenn).  Mr Oatham said Mr Lammas was riding forward with the stick and any correction was too late.

Mr Lammas admitted moving in a horse width but asked the Committee to consider the outward movement of the inside horses.

PENALTY SUBMISSIONS

Mr Oatham said Mr Lammas had incurred only 2 suspensions in the last 12 months and again referred to the fact that 2 horses had contributed to the interference.  He submitted this was at the lower end of carelessness.

Mr Lammas said he had commitments up to and including the 25 April 09.

PENALTY

--

The Committee carefully considered all evidence and submissions before imposing a penalty.  We took into account the following:
• Mr Lammas’ record
• His guilty plea
• Mitigating factor of 2 horses contributing to the interference.

--

Accordingly we impose a suspension on Mr Lammas from riding in races from after racing on 25 April 09 until after racing on 02 May 09 (4 days)
